Terms of Use

The pilot rules governing access to HatuaBid and responsibility for every tender decision and submission.

Draft for legal review: this pilot document is written for practical transparency and must be reviewed by qualified Kenyan counsel before public registration and paid client use.

1. Acceptance and authority

By creating an account or using HatuaBid, you accept these Terms and the Privacy Policy. You must be authorised to act for the named company and to upload its tender and company information.

2. Account and document responsibility

You are responsible for accurate information, secure credentials and account activity. You retain ownership of uploaded documents and permit HatuaBid and its providers to process them only as needed to provide and protect the service.

3. AI-assisted outputs

Outputs may be incomplete or incorrect and must be checked against the complete tender, all addenda and official clarifications. HatuaBid does not replace legal, procurement, financial or technical advice and does not guarantee eligibility, responsiveness or award.

4. Bidder obligations

  • Verify every deadline, amount, form, page and clause reference.
  • Confirm eligibility, prices, technical claims, signatures, stamps and approvals.
  • Handle original bid securities and physical requirements personally.
  • Complete a final human review before submission.

5. Credits and service

Package and credit terms are displayed before assessment. A completed run and a successful rerun may each use the applicable credit; a verified technical failure should not. Final payment, refund, expiry and tax terms will be stated at checkout.

6. Intellectual property and lawful use

HatuaBid Limited owns the platform, workflow, software and original content. Users must not bypass security, interfere with the service or access another company’s information.

7. Liability and law

HatuaBid is not responsible for unverified AI output, omitted or late source documents, bidder error, tender cancellations or procurement decisions to the extent permitted by law. Final commercial limitations and remedies require Kenyan legal review. These Terms are intended to be governed by Kenyan law.
